자, 반려견 훈련사 여러분, Training Without Conflict 팟캐스트에 다시 오신 것을 환영합니다. 이번 시간에는 다음 질문에 대해 다루겠습니다. 과연 미국의 반려견 훈련을 규제해야 하는가? 저는 이 질문을 수없이 많이 받아왔습니다. 팟캐스트에 출연하는 거의 모든 게스트와 이 주제에 대해 이야기하는 것 같습니다. 제 TWC 졸업생들, 현재 수강생들, 고객들, 그리고 물론 다른 많은 훈련사들과도 이 문제에 대해 대화를 나눕니다. 이는 계속되는 논쟁거리죠. 항상 사람들은 '아이반, 당신의 의견은 어때요?'라고 묻습니다. 어떻게 생각하시나요? 이 업계의 규제에 대해 어떤 입장이신가요? 그래서 제 입장을 명확히 밝히고자 합니다. 사실 규제라는 것은 반려견 업계를 발전시킬 수도 있지만, 완전히 망쳐버릴 수도 있습니다. 모두가 알다시피 현재 미국의 반려견 훈련 산업은 사실상 무법천지나 다름없습니다. 누구든 내일 당장 일어나서 스스로 반려견 훈련사라고 자칭할 수 있고, 행동 전문가, 공격성 전문가, 혹은 반려견 심리학자라고 부를 수도 있습니다. 게다가 설상가상으로, 요즘 대다수의 인플루언서들이 돈을 주고 산 소셜 미디어 팔로워 수나 '좋아요' 수를 마치 대단한 자격증인 것처럼 내세우기도 하죠. 하지만, 아무도 검증하지 않습니다. 기준도 전혀 없습니다. 책임 소재도 불분명합니다. 심지어 아무런 결과도 따르지 않을 수 있습니다. 물론 상황이 심각해져서 동물 보호 및 관리 당국과 같은 기관에 신고가 들어가지 않는 한 말이죠. 그리고 일이 잘못되었을 때, 우리 모두 알다시피, 그런 일은 일어나죠, 개들은 대가를 치르고 주인은 비용을 지불하게 됩니다. 그러니 절 믿으세요, 저는 왜 사람들이 규제를 원하는지 충분히 이해합니다. 저도 이 문제에 대해 스스로 고민을 거듭해 왔으니까요. 그 이면에 있는 동기를 완전히 이해합니다. 하지만 말씀드리죠. 규제에 대한 제 문제점들을요. 저는 우리가 이 문제에 대해 깊이 생각하고 있다고 보지 않습니다. 대체 어떤 종류의 규제를 모두가 실제로 요구하고 있는 걸까요? 만약 규제가 제대로 만들어진다면, 실질적인 문제들을 해결할 수 있을 겁니다. 사기와 학대, 무능, 태만 등을 줄일 수 있겠죠. 그리고 반려견 업계에는 규제가 완전히 타당한 상황들이 분명히 존재합니다. 예를 들어, 지금 반려견 훈련 분야에서 과학이라는 이름으로 팔리고 있는 엄청난 헛소리들 말입니다. 정말 터무니없죠. 사람들이 주말 코스를 듣고, 벽에 수많은 자격증을 걸어두고, 이름 뒤에 온갖 명칭과 약자를 붙인 다음, 갑자기 심각한 반려견 문제에 대해 조언을 하고 다니는 겁니다. 그리고 우리는 압니다. 견주들은 그 차이를 모른다는 걸요. 그들은 그저 라벨을 믿을 뿐입니다. 그래서, 네, 규제는 오해의 소지가 있는 마케팅과, 가짜 자격증, 가짜 권위를 줄이는 데 도움이 될 수 있습니다. 우리는 모든 위탁 훈련 시설의 전문가가... 어떤 곳은 훌륭하고, 어떤 곳은 정말 끔찍하다는 사실을 부정해서는 안 됩니다. 개들이 하루 종일 크레이트에 갇혀 있고, 규칙적으로 먹이를 주지 않으며, 감독도 없고, 용납할 수 없는 훈련 방식을 사용하는 것,
Alright, dog trainers, welcome to Training Without Conflict podcast once again. The question: Should dog training be regulated in United States? I've been asked this question over and over again. It seems like, I talk about this with every guest on my podcast. I talk about it with my TWC graduates, my current students, my clients, and and of course with many other trainers. It's an ongoing back and forth. It's always, Ivan, what's your opinion? What's your take? How do you feel about regulating the industry? So I'm going to give you my position. The truth is that regulation could either improve the dog world or absolutely destroy it. Everyone knows that right now, the dog training industry in the States is basically like the Wild West. Anyone can wake up tomorrow and decide that they're a dog trainer, behavior expert, aggression specialists, canine psychologists. And to top this off, we can add the numbers of followers and likes on social media that most influencers are paying for and consider it as credentials. However, nobody checks anything. There are no standards. There is no accountability. There may be even no consequences unless a situation gets reported to authorities, such as animal care and control. And when it goes wrong, which we all know, it happens, the dogs pay the price and the owners pay the bill. So believe me, I do understand why people want regulation. I've been going back and forth on this myself. I totally get the motivation behind it. But let me tell you my issues with regulation. I don't think we are thinking this through. What kind of regulation everyone is actually asking for? If regulation is built correctly, it could solve real problems. It could reduce fraud and abuse and incompetence, negligence and so on. And there are a hundred percent situations in the dog world, where regulation totally makes sense. For example, the amount of absolute nonsense being sold as science in dog training right now. It's unreal. People take a weekend course, put a bunch of certificates on the walls, add names, and letters behind their names, and suddenly they're giving advice for serious dog problems. And we know. We know that owners don't know the difference. They simply trust the labels. So, yeah, regulation could help produce misleading marketing, fake credentials, fake authority. We cannot pretend that every board and train facilities professional...some places are great and some places are absolutely disgusting. Dogs sitting in crates all day, not being fed regularly, no supervision, unacceptable training methods,

때로는 위생 상태마저 엉망이거나 의료적 방치는 말할 것도 없죠. 많은 개들이 그런 시설에서 죽어갑니다. 규제는 이런 기본적인 기준을 충분히 강화할 수 있습니다. 안전한 주거 공간, 깨끗한 환경, 음식과 물에 대한 접근권 같은 것들 말이죠. 네, 믿어주세요. 이것 또한 심각한 문제입니다. 개들에게 먹이와 물을 주지 않는 것. 최소한의 돌봄 요건. 필요할 때마다 받는 수의학적 검진. 물론 기록 관리도 포함되고요. 그 모든 것은 완전히 타당합니다. 그리고 당연히 중요하죠. 일부 훈련사들은 심각한 무는 습관이 있거나, 포식성 행동, 핸들러에 대한 공격성, 자원 방어 문제를 가진 개들을 맡고 있습니다. 그런데 그들은 실질적인 전문 지식도 없이, 안전 프로토콜이나 책임 보험 계획도 없이 그러고 있죠. 그래서 우리 모두 여기에 동의한다고 생각합니다. 이건 모두에게 위험합니다. 규제는 기본적인 사항을 요구할 수 있습니다. 다시 말하지만, 안전 기준, 위험 고지, 어쩌면 고위험 사례에 대한 보험 가입 의무화 같은 것들요. 여기까지는 아주 좋아 들립니다. 이제 여기서 제가 말하려는 부분은 아무도 듣고 싶어 하지 않거나 말하고 싶어 하지 않는 부분입니다. 대부분의 규제는 역량 중심적인 상태로 유지되지 않을 겁니다. 대신 결국에는, 즉각적이지 않더라도 이념 기반으로 변질될 것입니다. 그리고 제가 하는 말이 이해가 안 되신다면, 제가 한번 설명해 보겠습니다. 오늘날의 반려견 훈련은 단순히 개를 훈련하는 것에 그치지 않습니다. 이는 정치와도 관련이 있습니다. 정체성에 관한 것이기도 하죠. 물론 이데올로기와도 관련이 있습니다. 그런 환경 속에서 규제는 결국 무기가 될 뿐입니다. 왜냐하면 일단 규제가 도입되면, 그 규제에 영향을 미치는 사람들이 허용되는 범위를 통제하려 들 것이기 때문입니다. 그리고 허용되는 것들은 결과나 현실성에 근거하지 않을 것입니다. 누군가가 무엇이 도덕적으로 우월하다고 믿는지에 따라 결정될 것입니다. 따라서 규제가, 역량이나 복지 기준에 관한 것이 되는 대신, 도구 금지, 방법 금지, 처벌 금지에 관한 것이 될 것입니다. 기본적으로, 진정한 훈련이 불법이 되는 것이죠. 그것이 위험한 점입니다. 그리고 그것은 매우 타당한 위험입니다. 방법론 기반 규제에 대한 저의 가장 큰 문제 제기는 그것이 하나의 훈련 이데올로기만으로 항상 충분하다고 자동으로 가정한다는 점입니다. 긍정 강화(positive reinforcement)만으로 항상 충분하다고 가정하는 것이죠. 그것만 있으면 된다는 식으로요. 하지만, 우리는 트레이너가 현실 세계에서 고갈등 행동을 다뤄야 하는 순간 그 믿음이 무너진다는 것을 알고 있습니다. 특히 공격성이나 포식성, 통제되지 않는 흥분, 위험한 충동적 행동 같은 것을 다룰 때는 더욱 그렇습니다.
sometimes even poor hygiene or not to mention the medical neglect. Many dogs die in such facilities. Regulation could totally reinforce basic standards like this. Like safe housing, clean environment, access to food and water. Yeah, believe me. This is also a serious problem. Not allowing dogs to eat and drink. Minimum care requirements. Veterinary check up whenever needed. Documentations, of course. All that is totally reasonable. And of course it matters. Some trainers are taking on dogs with serious bite histories or predatory behavior, handler aggression, resource guarding. And they're doing that with no actual expertise, no safety protocols, no liability planning. So I think we all agree here. This is dangerous for everybody. Regulation could require basic things. Again like I said like safety standards, risk disclosure, insurance requirement maybe for high risk cases. So far it sounds great. Now here is where I'm going to say the part that nobody either wants to hear or talk about. Most regulations won’t stay competency based. Instead, it will become eventually, if not immediately, ideology based. And if you don't understand what I'm saying, let me let me try to explain. Dog training today is not just about training dogs. It's also about politics. It's about identity. Of course, it's about ideology. And in that environment regulation will become nothing else but a weapon because once regulation is in place, the people who influence it will try to control what's allowed. And what's allowed will not be based on results or realism. It will be based on what someone believes is morally superior. So instead of regulating, instead of regulation being about competence and welfare standards, it's going to become about banning tools, banning methods, punishment bans. Basically, real training becomes illegal. And that's the danger. And it's very legit danger. My biggest problem with method based regulation is that it automatically assumes that one training ideology is always enough. It assumes that positive reinforcement alone is always sufficient. It's all we need. However, we know that the belief collapses the moment a trainer has to deal with high conflict behavior in the real world, especially when we're talking about stuff like aggression and predation and uncontrolled arousal, dangerous impulsive activity.

기꺼이 감수하려는 사람들은 각기 다른 방식의 정적 강화 스케줄을 헤쳐 나가며, 유전적으로 설계된, 상황이 주어질 때마다 전력을 다하는 개들 말입니다. 이런 이야기는 끝도 없이 할 수 있습니다. 도구(훈련 도구)나 결과(처벌)가 제거된다고 해서, 마법처럼 윤리적인 훈련이 만들어지는 것은 아닙니다. 우리는 오히려 통제가 중요한 상황에서 확실하게 통제할 수 없는 개들을 만들게 되며, 그것은 더 나은 복지가 아니라, 오히려 끝없는 관리와, 지속적인 제약, 개들을 이 집 저 집, 구조 단체, 보호소로 전전하게 만듭니다. 그리고 네, 결국에는 안락사까지 고려하게 되는 것이죠. 그래서 많은 경우, 인도주의적인 방식만을 규제하도록 밀어붙이는 사람들은 결국 훨씬 덜 인도적인 결과를 초래하게 됩니다. 그것이 바로 여기서 말하는 안타까운 아이러니입니다. 규제와 관련된 또 다른 문제는 이렇습니다. 규제는, 대부분의 경우, 훈련사의 기술이나 전문성이 아니라 서류 작업을 제대로 하는 사람에게 보상을 줍니다. 이는 성공하는 사람들이 서식을 채우고, 체크리스트를 확인하며, 물론, 정치적 수단을 부리는 자들이 되는 세상을 만듭니다. 실제로 개를 이해하고, 갈등을 다루며, 통제력을 키우고, 자신감을 구축하며, 위험한 행동을 멈추게 하고, 개를 안정적이고 책임감 있게, 그리고 기능적으로 만드는 훈련사가 아니고요. 결국 우리가 마주하게 될 결과는 면허는 있지만 여전히 무엇을 해야 할지 모르는 훈련사들일 것입니다. 합법적이라는 것이 유능하다는 것을 의미하지는 않기 때문이죠. 그래서 그래요, 업계는 서류상으로는 더 안전해질지 몰라도 실질적인 역량을 갖춘 훈련사를 찾기는 더 어려워질 수 있습니다. 이 방송을 듣고 계신 분들 중에는 여전히 규제가 도움이 될 수 있다고 믿는 분들이 계실지도 모르겠지만, 제가 지지할 수 있는 유일한 모델은 이것입니다. 규제는 방법론에 기반해서는 안 되며, 성과와 역량에 기반해야 합니다. 무슨 뜻이냐고요? 안전을 규제합시다. 시설 기준을 규제합시다. 투명성과 책임성을 규제하세요. 대중의 위험을 규제합시다. 하지만 이념을 법으로 강제할 수는 없습니다. 반려견 산업에는 정부가 승인한 종교 같은 것은 필요 없습니다. 우리에게 필요한 것은 진짜 훈련과 진짜 훈련사들입니다. 그게 핵심입니다. 여기 제 대답이 있습니다. 만약 규제가 학대를 막고, 사기를 방지하고, 태만한 시설을 제재하며, 안전 수칙을 의무화하고, 실제 피해에 대해 훈련사에게 책임을 묻는 것을 의미한다면, 네, 그런 규제는 반려견과 보호자, 훈련사, 그리고 모두에게 좋은 일이 될 것입니다. 하지만 규제가 도구를 금지하고, 교정 방법(consequences)을 금지하며,
Those that are willing to fight through different positive reinforcement schedules, those that are genetically designed to go all in whenever the situation presents itself. And I can go on and on on this. When tools or consequences are removed, we don't magically create ethical training. We create dogs who cannot be reliably controlled in situations where control matters, and that leads not to better welfare, but instead endless management, constant restriction, passing dogs from home to home, to rescue, to shelter. And yeah, eventually, being euthanized is on the table. So in many cases, the people who push for humane only regulations end up creating outcomes that are far less humane. And that's the unfortunate irony here. Another problem with regulation is this: Regulation, most of the time, rewards someone doing proper paperwork and not the skill or the expertise of the trainer. It creates a world where the people who succeed are the ones who can fill out forms, check boxes, and of course, play the politics. Not the trainers who actually can read dogs, handle conflicts, build control, build confidence, stop dangerous behaviors, keep dogs stable and accountable and functional. So what we’re going to end up with is licensed trainers who still don't know what they're doing. Because being legal doesn't mean being competent. So yeah, the industry could become safer on paper while actual competence becomes harder to find. Since you're listening to this, and you still may believe regulation could help, here is the only model I can support. Regulation must be outcome based and competency based, not method based. What do I mean? Let's regulate safety. Let's regulate facility standards. Regulate transparency and accountability. Regulate public risk. But we cannot legislate ideology. The dog industry doesn't need a government approved religion. We need real training, real trainers. That's what it's about. Here's my answer. If regulation means stopping abuse, stopping fraud, stopping the negligent facilities, requiring safety protocols, holding the trainers accountable for real harm, then yeah, that regulation would be good for dogs, owners, trainers, everybody.

But if regulation means let's ban tools, let's ban consequences. Let's outlaw effective training because it makes some people uncomfortable. Then no. Like absolutely not. Because that won't protect dogs. That will actually do the opposite. They will sacrifice dogs. In another recent podcast, I challenge the AVSAB and their ridiculous position statement on this with real dogs that were going to be euthanized and now live happy lives. Dogs deserve to be given the chance to succeed instead of being written off because an ideology failed to help them. The dog industry doesn't need more of ideology. We need honesty. We need competence. We need accountability, that's for sure. It needs people who actually have the ability to take a dog with real, serious issues and bring it back into control. Clarity stability.
